Employment contract terminates without notice
Your employment contract will end without notice being required if you resign/are dismissed during your probationary period, if your temporary employment contract (D-3 or D-4) expires, if you have reached the state pension age and in the event of your death, for example. More situations can be found in Article Q-1, paragraph 2 of the CAO HBO.
If you have an employment contract for a definite period (D-4), it will end by operation of law. This means that the employment contract will end automatically following the expiry of a particular period. This may be due to the fact that the temporary work has been completed or the period of replacement during illness is coming to an end. No notice period applies in such cases.
AUAS does, however, have to observe a written notification period of one month prior to the expiry of an employment contract for a definite period of six months or more. In such cases, AUAS is required to inform you in writing at least one month before the temporary employment contract ends that your employment contract will be terminated. At AUAS, it has been agreed that your supervisor/manager will meet with you to inform you in good time that the employment contract will be terminated and that you will not be offered a new employment contract. In the case of an expansion of the employment contract (D-6), this expansion will also end by operation of law. No notification period applies in the case of a temporary expansion, since this is not an independent employment contract.
If you have an employment contract (D-3) with the prospect of an employment contract for an indefinite period, this can only be terminated if it emerges in an assessment that you are performing inadequately or in the case of substantial business interests. This can entail an unexpected, rapid contraction of a particular degree programme or another business risk as a result of which the continuity of the degree programme or the university of applied sciences is compromised. In all other situations, a D-3 is converted into a permanent employment contract (D-2) after the period has expired.
At least four months prior to the end date of your employment contract, you will be told whether your employment contract will be converted into a D-2 or will be terminated. You will be notified of this in writing. In addition, AUAS must observe a written notification period of one month if a D-3 contract has a term of six months or more (see also under ‘D-4 employment contract terminates’).
If you have an employment contract for a definite period with a term of more than one year, then this employment contract can be terminated early. The notice period for both you and AUAS is two months.

If you die during your employment with AUAS, your employment contract will end by operation of law. Your surviving relatives will then receive survivor's benefit from AUAS, pursuant to the CAO HBO.
This benefit is calculated for all AUAS employees in the following manner: on the date of death, gross income including holiday allowance and year-end bonus + child benefit for an average family per month x 3. The benefit is paid out by AUAS as quickly as possible, and at the latest within one month, by means of a deposit to the deceased employee's account. It is the surviving relatives’ responsibility to obtain access to this account, or to arrange through a civil-law notary for the benefit to be paid into another account.
